These Terms of Use (the "Terms") govern your access to and use of the mobile game Fish Inc. (the "Game") published by Big Time Labs ("we", "us", "our"). By downloading, installing or playing the Game, you agree to these Terms. If you do not agree, please do not use the Game.
1. Eligibility
You must be at least the minimum age required to form a binding contract in your country of residence, and meet any minimum age set by the relevant app store. If you are a minor, you may only use the Game with the consent and supervision of a parent or legal guardian, who accepts these Terms on your behalf.
2. License to use the Game
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the Game on a device you own or control, for your personal, non-commercial entertainment.
3. Restrictions
You agree that you will not:
- copy, modify, reverse-engineer, decompile or attempt to extract the source code of the Game, except where permitted by law;
- use cheats, bots, automation, exploits, modified clients or any unauthorized third-party software to gain an unfair advantage or disrupt the Game;
- sell, rent, sublicense, distribute or commercially exploit the Game or any part of it;
- circumvent, disable or interfere with security or anti-fraud features, or the Game's economy;
- use the Game for any unlawful purpose or in violation of these Terms or any applicable law.
4. Virtual items and in-app purchases
The Game is free to download and offers optional in-app purchases as well as in-game virtual currencies and items (such as pearls, lures, coins and upgrades) ("Virtual Items").
- Virtual Items have no monetary value, cannot be exchanged for real money or anything of value outside the Game, and are licensed — not sold — to you.
- All purchases are processed by the relevant app store (Apple App Store or Google Play) and are subject to that store's terms and refund policies.
- Purchases are generally final and non-refundable, except where required by applicable law or granted by the app store.
- We may, at our discretion, manage, modify, regulate or remove Virtual Items, and we may change prices at any time.
- Virtual Items may be lost if your game data is deleted, if the Game is discontinued, or if your access is terminated.
5. Updates and availability
We may update, modify, suspend or discontinue the Game (or any feature, zone or content within it) at any time, with or without notice. We do not guarantee that the Game will always be available, uninterrupted or error-free.
6. User conduct
You are responsible for your use of the Game and for keeping your device secure. You agree not to use the Game in any way that could damage, disable or impair our services, or interfere with another player's use of the Game.
7. Intellectual property
The Game and all related content — including code, graphics, characters, artwork, audio, text, logos and trademarks (including "Fish Inc." and "Big Time Labs") — are owned by us or our licensors and are protected by intellectual-property laws. Except for the limited license granted above, no rights are transferred to you.
8. Disclaimer of warranties
The Game is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose and non-infringement, to the maximum extent permitted by law. Nothing in these Terms limits any statutory rights you may have as a consumer.
9. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or Virtual Items, arising out of or related to your use of the Game. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
10. Termination
We may suspend or terminate your access to the Game if you breach these Terms, engage in fraud or abuse, or as otherwise required by law. You may stop using the Game at any time by uninstalling it. Provisions that by their nature should survive termination (such as intellectual property, disclaimers and limitations of liability) will continue to apply.
11. Privacy
Your use of the Game is also governed by our Privacy Policy, which explains how we handle your data.
12. Third-party stores and services
Your download and use of the Game are also subject to the terms of the app store from which you obtained it. The Game may include third-party services (such as advertising and analytics) governed by their own terms. Apple and Google are not parties to these Terms and are not responsible for the Game.
13. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Your continued use of the Game after changes take effect constitutes acceptance of the revised Terms.
14. Governing law
These Terms are governed by the laws applicable at the place of business of Big Time Labs, without regard to conflict-of-law principles, and subject to any mandatory consumer-protection rules of your country of residence.
